    The Murder on the Orient Express Contest

    Official Rules

    October 10, 2017- October 19, 2017

    NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. Void where prohibited. The Murder on the Orient Express Contest  (“Contest”) will begin on October 10, 2017 at approximately 12:00 noon ET and end on October 19, 2017 at 5:00 p.mET (“Contest Period”). All times in the Contest refer to Eastern Time (“ET”).  Contest is subject to all applicable federal, state and local laws.

    ELIGIBILITY: Open only to permanent, legal United States (“U.S.”) residents who are physically residing in one of the forty-eight (48) continental United States or the District of Columbia (excluding Alaska, Hawaii, Puerto Rico, Guam, the Virgin Islands and other United States territories) and who are twenty-one (21) years of age or older and of the age of majority in their state of residence as of the start of the Contest Period.  Officers, directors, and employees of Contest Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Contest.  Contest Entities, as referenced herein, shall include the Today Show (“TODAY”) and NBCUniversal Media, LLC, both located at 30 Rockefeller Plaza, New York, NY 10112 (collectively, “Sponsors”), Twentieth Century Fox Film Corporation (“Fox”), and each of their respective parent, subsidiary, and affiliate companies, and their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Contest, including but not limited to the prize provider.

    TO ENTER: To enter the Contest, during the Contest Period  visit (the “Website”), click on the Connect button and follow the provided instructions to complete and thereafter submit an entry form, which includes your name, address, telephone number, email address, and date of birth and Contest answer (the “Entry”). Your Entry is to contain your answer to the following Contest question: “Tell us what character from Murder on the Orient Express are you or would you want to be and why?” All Entries become the property of Sponsors and will not be acknowledged. The judging criteria for the Contest is creativity (50%) and originality (50%). 

    You may enter once during the Contest Period. Limit one (1) Entry per person/email address. Multiple Entries received from any person or unique email address beyond the above stated limit will void all such additional Entries. All required Entry Information must be completed in full. Any attempted form of Entry other than as described herein is void. Entries generated by a script, macro, or other automated means or by any means that subverts the entry process will be disqualified. Entries must be received by October 19, 2017 at 5:00 pm ET to be eligible for the Contest. Sponsors’ computer shall be the official timekeeper for all matters related to this Contest. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted.  In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. “Authorized account holder” is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.  Entry constitutes permission (except where prohibited by law) by Sponsors and Fox to use entrant’s name, city, state, likeness, image, Contest entry (“Contest Entry”) and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval. 

    WINNER SELECTION AND NOTIFICATION:  On or about October 20, 2017 Contest judges (“Judges”) selected by Sponsor will pick one (1) Grand Prize winner (“Winner”) from all eligible Entries received during the Contest Period based on the judging criteria (“Judging Criteria”) of 50% originality and 50% creativity. In all matters, the decisions of the Judges and Sponsor shall be final. Sponsors and or prize provider (“Prize Provider”) will make an attempt  to notify potential Winners at the phone number and/or email address submitted at the time of entry.  Sponsors may share potential Winner’s name and contact information with Contest Entities and/or any Prize Provider, or manufacturer as applicable, if necessary. Potential Winner and guest of Winner (“Guest”) will be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Contest Documents”) within one (1) day of such notification.  Noncompliance within this time period may  result in disqualification, and, at Sponsors’ sole discretion an alternate potential Winner may be selected from the remaining eligible entries. If potential Winner cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, potential Winner will be disqualified and time permitting, at Sponsor’s sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries by the Judges based on the Judging Criteria.  Guest of Grand Prize Winner must be 18 years old or older, unless Guest is the child/legal ward of Winner.

    GRAND PRIZE:  There will be one (1) Grand Prize awarded (“Grand Prize”). The Grand Prize will consist of the following:

    • Two coach airline tickets for Winner and Guest departing from the major airport closest to winner, to Venice, Italy, arriving October 31st,2017 and hotel accomodations of Fox’s  choice in Venice for one (1) night (single room/double occupancy).  
    • Travel for Winner and Guest on the Venice Simplon-Orient-Express train for an overnight journey on November 1st,2017 from Venice to Paris. 
    • Travel for Winner and Guest from Paris to London via Eurostar to attend the World Premiere of Murder on the Orient Express in London with one (1) night overnight accommodations provided at a hotel of Fox’s choice (single room/double occupancy).
    • Return airline transportation for Winner and Guest from London to the major airport closest to winner’s home on November 3rd, 2017.


    Winner and Guest are responsible for all other transportation, as well as meals and incidentals which includes beverages on board the train.


    Estimated Retail Value (“ERV”) of the Grand Prize is $12,000. Grand Prize will be awarded “as is” with no warranty or guarantee, either express or implied by Sponsors. Sponsors reserve the right to determine the item that Winner will receive and reserve the right to substitute a similar Prize (or Prize element) of comparable or greater value.

    ERV of Prize received will vary based on Prize awarded subject to Sponsor’s sole discretion.  Actual retail value (“ARV”) of Prize will vary depending on Prize selected by Sponsors. Any differences between stated ERV and ARV will not be awarded.

    All details of Prize will be determined by Sponsors in their sole discretion.  Sponsors reserve the right to substitute Grand Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. If the Premiere portion of the Grand Prize becomes unavailable due to scheduling conflicts, cancellations, or any other reason, Winner will be awarded the remaining portion of the Grand Prize, which will constitute the full Grand Prize, and there will be no substitution of the Premiere portion of the Grand Prize.  All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Grand Prize are the sole responsibility of Winner. Prize cannot be transferred by Winners or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Grand Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible Entries at Sponsors’ sole discretion. Winner and Guest will require a passport valid for at least 6 months on date of travel; any necessary visas or insurance are the sole responsibility of the Winner and Guest.

    Winner and travel companion must travel together on the same itinerary and must comply with any applicable hotel check-in requirements, such as presentation of a major credit card. Travel companion of the Winner will be required to execute a Release of Liability prior to departure. Winner and travel companion must possess valid travel documents (i.e., valid passport, valid government issued photo ID, etc.) in order to travel.  Winner and travel companion are responsible for obtaining a visa and all necessary immigration permits/permissions if required for entry into the United States and all costs associated thereto. Dates of departure and return are subject to change. Seat selection and timing of trip subject to availability and confirmation of reservations. No refunds or credit for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to, airline baggage fees, taxes, tips, entertainment, and airport transportation to and from Winner’s home residence are the Winner's sole responsibility.  Airfare may not include government taxes, Passenger Facility Charge or September 11th Security Fee.  Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles.  Other travel restrictions and blackout dates may apply.  All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes.  The ARV for travel prizes may vary depending upon points of departure and destination and fare fluctuations.  Sponsor reserves the right to structure travel routes and select hotels in its sole discretion.  The ARV for travel prizes is an estimate made before the Promotion begins.  The Winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules.  The round trip air transportation element for any travel prize begins and ends at the point of departure.  No interest will be awarded on cash prizes.  Other hotel fees are not included and if applicable may be payable at the time of check-out by the Winner/guest.  A deposit or payment in advance, or presentation of a credit card by the Winner, may be required at the time of check-in at the hotel.  Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly, and the Winner is solely responsible for any charges and/or fees arising from changes made directly with the hotel.  The Prize restrictions/conditions stated herein are not all-inclusive and the Grand Prize described above may be subject to additional restrictions/conditions.  In the event the Winner and/or his or her Guest engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the Grand Prize or other applicable experience early, in whole or in part, and send the Winner and/or his or her Guest home with no further compensation.

    CONDITIONS: By entering the Contest, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Contest Entities and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the or Contest and/or his/her acceptance, possession, use, or misuse of Grand Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Contest and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on the Website and the use by Released Parties of such name, voice, image, Contest Entry and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Contest itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Contest at Sponsors’ sole discretion.

    ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules.  Any attempt to deliberately damage the Contest or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.  Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Contest. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Contest or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules).  In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect Entries received prior to the time of the event warranting such cancellation, modification, or suspension.  Notice of such cancellation, modification, or suspension will be posted on the Website.  Sponsors may prohibit any entrant or potential entrant from participating in the Contest, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).  Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest.

    DISPUTES:  The Contest is governed by, and will be construed in accordance with, the laws of the State of New York, and the forum and venue for any dispute shall be in New York, New York. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in new york.  All proceedings brought pursuant to this paragraph will be conducted in the County of new york.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
